Regional Transport Authority

P.N. Ravindran, J.

W.P. (C) No. 68 of 2011 (G)

Dated this the 4th day of January, 2011

K.A. Rasheed Vs. Regional Transport Authority

For Petitioner  :DR.K.P.SATHEESAN

P.N. Ravindran, J.

1. The Petitioner is a stage carriage operator, operating a stage carriage on the route Arrattuvazhi Beach-Cherai via Cheraman, on the strength of a regular permit which is valid till 1.6.2015. The Petitioner applied to the Regional Transport Authority, Thrissur, for variation of the route. The said application was considered by the Regional Transport Authority at its meeting held on 15.11.2010. The Regional Transport Authority decided to grant the variation sought for, subject to settlement of timings. The grievance voiced by the Petitioner is that, though nearly two months have passed after the variation sought for was granted and the current records were produced on 14.12.2010, till date the permit has not been issued. In this writ petition, the Petitioner seeks a direction to the second Respondent to settle the timings and issue the permit on the basis of Ext.P1 proceedings, within a time limit to be fixed by this Court.

2. Sri. Basanth Balaji, the learned Government Pleader appearing for the Respondents submitted that the Secretary of the Regional Transport Authority will settle the timings and issue the varied permit to the Petitioner pursuant to Ext.P1 proceedings expeditiously. In the light of the said submission, I dispose of this writ petition with a direction to the second Respondent to issue a varied permit to the Petitioner after settling the timings expeditiously and at any rate within two months from the date on which the Petitioner produces a certified copy of this judgment before him. The second Respondent shall settle the timings with notice to the Petitioner and other operators, operating stage carriages on the route in question.
